At Survey.com we are committed to being open and transparent with you about how we collect, store, share or otherwise use “process” your personal information. This Privacy Policy lays out how and why we process your personal information, along with explaining your individual rights and how you can exercise them.
This policy covers our Survey.com website (“Site”), mobile applications (“Survey App”), performance dashboards and related services (collectively the “Services”). Your access to and use of the Services is subject to the Survey.com Terms of Services. Terms not defined in this Privacy Policy are defined in the Survey.com Terms of Service.
Who we are
Survey.com, including our parent company and affiliates (“Survey.com”, “we”, “us”, “our”) are operated by BET Information Systems, Inc. (“BET”). Survey.com connects individuals that sign up to our Services (“Merchandisers”, “Users” or “you”, “your”) to paid in-store retail service jobs, projects and gigs.
Our brand and retail customers (“Customers”, “Partners” or “you”, “your”) that partner with us can post in-store jobs or “projects” that are then accessed by our Merchandiser community via the Survey.com mobile application, Merchandiser mobile application or Flexx mobile application (collectively the “Survey App”).
This Privacy Policy relates to the processing of:
- The personal information that we collect when individual Merchandisers sign up to and/or use our Survey App and Services.
- The personal information that we collect from our brand and retail partners who partner with us to offer in-store retail projects to our Merchandiser community and who use the Services to view project data collected for their brand and retail stores and outlets.
- Personal information of any other person that visits our website, signs up to or uses our Services and/or provides additional information to us.
When we refer to “personal information” in this Privacy Policy we mean: “any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly to a particular individual or household.
Please read this Privacy Policy carefully. If you do not agree to the terms of this Privacy Policy, please do not register, subscribe, create an account or otherwise interact with Survey.com.

1. How do we collect your personal information?
We collect personal information about you from the following sources depending upon the types of Services you have signed-up to or whether you are a Merchandiser or one of our brand or retail partners.
- From information you provide directly to us through the Survey App, including through our Automated Assistant Chat Bot, ‘Steve’, via our website, and our Services, through surveys or questionnaire’s you complete or through any other communication channels you use to provide information to us.
- From information automatically transmitted or collected from your mobile or other hardware devices via the Survey App or when you visit our website or access our Services – such as your IP address, information collected via website cookies or pixels and your geo-location information when you enable this feature.
- From information provided to us directly or via the Survey App or Services from our brand or retail Partners relating to the performance and completion of jobs or projects performed by a Merchandiser.
- From our third-party agencies where we work with these in Europe to help support the recruitment and management of our Merchandiser community and Survey.com projects and services.
- From third parties or separate data controllers that support the services provided to individual Merchandisers. These include our approved:
- background checking agency (we only undertake these checks when specifically required by one of the brand and retail partners we work with and where you have given your permission for us to do so).
- payment agency, so that we can pay you for work completed. Survey.com do not directly process or store any payment card information or account details of our Merchandisers. This type of financial information is only collected and stored by our approved payment agency when you sign up to our services.
2. What personal information do we process about you and why (including any sensitive personal information)?
2.1. Independent Merchandisers operating in the US and Canada
Survey.com collect and process the following types of personal information to provide you with access to our Survey App, the Services and to the gigs, jobs or projects that are posted by our brand and retail partners. We also use this personal information to pay you for jobs or projects completed, to communicate with you and provide updates about the Services and to provide feedback on the quality and accuracy of work completed to our brand and retail partners. We use the shelf and product images collected by you to provide our services to our brand and retail partners and for internally developing and improving our products and services.
- Basic contact information such as your name, email and phone number.
- Your address if certain projects require us to ship products or materials to you.
- Your date of birth.
- Your work schedule preferences if you choose to provide this information.
- Your Survey.com ID number, created when you sign-up to the Survey App.
- Your photograph.
- Mobile device information including unique device identifier, user settings, the make model and operating system of your device.
- Approximate and precise geo-location information in order to provide you with notifications of relevant jobs or projects in your area and to enable you to locate stores and locations in order to carry out the work. To enable us and our brand and retail partners to monitor the completion of jobs in-store and to prevent and detect any fraudulent activities.
- System log-in data and your password (hashed).
- Identification documents such as a copy of your driver’s license, state ID, passport or birth certificate.
- Confirmation of insurance form.
- Your social security number.
- Performance information, including feedback from our brand or retail partner, relating to your use of the Services and completion of jobs or projects. For example, stores visited, the time and duration of your visit and the quality of work completed.
- Details of jobs completed and feedback/scores provided by our brand and retail partners.
- Any health and safety incidents or fraudulent or criminal activity relating to any jobs or work you carry out when using the Services and where it is necessary for us to receive this information to protect our independent merchandisers and/or our brand and retail partners and their staff.
- Information related to your earnings for jobs or projects completed.
- Survey responses and feedback you provide to us if you choose to do so.
- The contents of any correspondence you send to us using various communication channels such as via our Automated Assistant Chat Bot on the Survey App, through our messaging services, text, email, social media or letter or when you contact our Customer Services Team.
- Confirmation of ‘no criminal’ record from our background checking agency when this is required by a brand or retail partner in order for you to undertake a job or project they have posted. We only have access to more detailed background check information if there is a specific investigation over conduct or criminal activity and/or where we are required to provide specific information to a state or law enforcement authority.
- Payment reference ID number relating to payments you have received for work or projects completed. Information relating to your payment card information or bank account details are only held by our approved payment agency and cannot be accessed by Survey.com.
Collection of sensitive personal information – independent Merchandisers operating in California
California data privacy laws require us to inform Merchandisers operating in California about any personal information we collect that is considered to be ‘sensitive personal information’ under such laws.
We collect the following types of sensitive personal information about you. We only collect this type of information when it is necessary to perform the services you have signed up to or requested that we provide to you.
Precise geo-location information together with a date and time stamp
We collect this information when you have agreed to this within the Survey App. We collect it for the following purposes:
- To provide you with notifications of relevant jobs or projects in your area;
- To enable you to locate stores and locations to carry out the jobs you have signed up to;
- To enable Survey.com and our brand and retail partners to confirm that you have visited the store and completed the work you have agreed to in order to pay you for these services.
- To help prevent and detect any fraudulent activities.

Please note: by restricting or disabling geo-location tracking, you will be restricting and preventing certain functionalities of the Survey App from working as outlined above. This is because these functionalities require the use of geolocation data to function correctly.

Identification documents and details (including driver’s license, passport, state ID card and social security number)
We collect this information to verify your identity. This enables us to validate your identity to access the Services and to ensure we are paying the correct individual for work completed through our payment processing partner and for undertaking any statutory reporting as required by law.
2.2 Independent Merchandisers operating in Europe
Information relating to your employment and to payment for delivering the services you agree to provide to Survey.com are collected, stored and processed separately by the Agency that employs you. Survey.com does not have access to this personal information. 2.3 Personal information collected from our brand and retail partners
Survey.com collect and process the following types of Personal Information to provide access to our Services, including the DMX dashboard, to our brand and retail partners and to tell you about our products and services.
- Your name, workplace and job role.
- Your Work email address (unless you provide us with a personal address to sign-up to our services).
- Work phone No (unless you provide a personal number to sign-up to our services).
- System log in data and password (hashed).
- IP address, and related mobile device or operating device information.
- System log in data.
- Information about how you use and interact with our DMX Dashboard for analytics purposes.
- The contents of any correspondence, queries and system support requests sent to Survey.com and a copy of any responses provided.
2.4 Personal information collected to manage and improve the Survey.com App and website.
- Mobile Device Information including device identifier, user settings, the make model and operating system of your device.
- Information that we collect about you through our use of cookies, pixels, tags and similar tracking technologies. See Section 6, ‘How do we use cookies and similar technologies’ for further information.
2.5 Other additional purposes
We may also use the personal information listed in this Privacy Policy for the following purposes where we have a legal requirement or a legitimate business interest to do so:
- Merger, Sale, or Other Asset Transfers. We may process your information to effect a corporate transaction involving Survey.com, including a merger, acquisition, or otherwise, and to support the sale or transfer of our business assets.
- As Required by Law, to Enforce Laws and Similar Disclosures. We may process your information, including information that identifies you, to defend ourselves in litigation or a regulatory action; when required or advised to do so by law, such as in response to a subpoena, or similar legal process, including to law enforcement agencies, regulators, and courts in the United States and other countries where we operate; to enforce our rights or protect our property; to protect the rights, property or safety of others, investigate fraud, or respond to a government request; or as needed to support auditing and legal compliance functions.
- To create aggregated and de-identified statistical data. We may use your information to create anonymized, aggregated statistical data (that is no longer identifiable personal information), to develop, improve and promote our services and products and to create statistical insights to share with our retail and brand partners to deliver our agreements with them.
3. For individuals located in California: California Consumer Privacy Act/California Privacy Rights Act: Do we “sell” or “share” your personal information?
We do not “sell” or “share” your personal information, including your sensitive personal information, with any third parties as these terms are defined in the California Consumer Privacy Act, California Privacy Rights Act or other applicable US privacy laws.
4. Who do we disclose your personal information to or which other third parties have access to it when using the Services?
We take care to only share or allow access to your personal information to individuals or third parties who really need it to perform the Services or who have a legitimate purpose for accessing it.
We may share your personal information with the following:
- Other Survey.com or Trax group companies – in order to develop, improve and provide our services.
- Service providers and vendors and other third parties who provide services on our behalf or support the Services we provide to you– such as back-office and support staffing and contractors, providers that support the operation of our Survey App Automated Assistant Chat Bot, IT software and cloud providers, payment and transactions providers, geo-location services, data analytics services, marketing companies, survey platforms and IT and cyber security services.
- Our brand and retail partners – to provide our brand and retail partners with the necessary information allowing them to post available jobs on our Services, manage health and safety and any related legal requirements in relation to jobs completed by our Merchandisers and confirm that jobs have been completed in accordance with their requirements.
- Our third party Agencies – who source and provide independent merchandisers to undertake in-store jobs and projects for us in Europe.
- Rep team leaders – where we have staffing teams of independent Merchandisers we may share your relevant contact details with the ‘team leader’ to help them co-ordinate team members for in-store jobs or projects.
- With other third parties such as our legal advisors or law enforcement or federal agencies – but only in specific cases and where we have a legal requirement to do so and for the following types of purposes:
- In connection with the establishment, exercise, or defence of legal claims.
- To comply with laws and regulations or to respond to lawful requests made to us.
- To protect our rights and property and the rights and property of our agents, Merchandiser community, brand and retail partners, and others, including to enforce our agreements, policies and terms of use.
- To detect, suppress, or prevent fraud.
- To reduce credit risk and collect debts owned to us.
- As otherwise required by applicable law.
- Otherwise with your consent or at your discretion – we may disclose your personal information to certain other third parties or publicly with your consent or direction. If you post a comment or review on our website or a comment on our social media sites, the information you provide may be displayed publicly online for others to view.

If you are a Merchandiser or brand or retail partner in the EU/EEA or UK, our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the context in which we collect it. 6.2 On our Survey App
Necessary and Functional Cookies: We use an ‘auto log-in’ cookie in order to automatically login the Merchandiser / user to their web account. If the login cookie is not available, then a login form is presented to the user to authenticate.
We do not use any Third Party or Targeting Cookies for targeting, advertising or similar purposes on our Survey App at this time.
7. Your rights and choices
Managing your account and contact with us
Profile Access. You can directly access and update your profile information, such as your name, address and can change some of your preferences on your account page within the Survey App.
Location and Device Permissions. You can control location tracking by adjusting your location services options on the “Settings” app on your mobile device. We may continue to approximate your location based on your IP address when you access the services through a computer or device. If you would like to update your device content access permissions, such as permissions to access your camera, you can do so in the “Settings” app on your mobile device. Please note that if you choose to disable location tracking this will mean that we are unable to offer you certain features and benefits that are essential to the operation of the services such as finding nearby stores and undertaking in-store jobs and projects.
Promotional and Marketing Messages. You can stop receiving promotional email communications from us by following the “unsubscribe” instructions provided in such communications or by contacting us at support@survey.com
We make every effort to promptly process all unsubscribe requests. You may still receive service-related communications, including account verification, transactional communications, changes/updates to features of the services, and technical and security notices.
Your data privacy rights
Depending upon your state of residency and certain legal limitations and exceptions, you may be able to access some or all of the following rights.

We will acknowledge receipt of your data privacy rights request within 5 working days and provide a full response to you within the legally required timescales.
The right to access – You may request access to copies of the personal information that Survey.com has collected about you. Specifically, you may ask Survey.com to tell you: (a) the types of personal information Survey.com holds about you; (b) where the personal information was collected from; (c) the purposes for which Survey.com collects, uses, or has sold, or shared your personal information; (d) who Survey.com discloses your personal information to.
You may request for a copy of your personal information in a portable and to, the extent technically feasible, in a readily useable format that allows you to transmit it to another third party.
The right to deletion – You may request that Survey.com delete the personal information it holds about you in certain circumstances, such as where it has been unlawfully processed, or where there is no overriding legitimate ground for processing it.
The right to correct inaccurate information – You may update or correct your personal information at any time by visiting your profile’s account setting page. If you are unable to update or correct any inaccurate information through your account settings, you can ask us to correct inaccurate personal information about you on your behalf.
The right to request the restriction of your personal information from further processing – You may ask Survey.com to restrict the processing of your personal information in certain circumstances.
Right to limit the use and disclosure of sensitive personal information – Individuals in certain US states can also request that Survey.com limit its use and disclosure of your sensitive personal information to that which is necessary to perform the services or provide the goods reasonably expected by an average consumer. Please note, we only use sensitive personal information to provide the necessary and specific services that you have signed up for.
The right to withdraw your consent to the processing of your personal information – where we are relying on your consent to do so. Withdrawing your consent will not affect the lawfulness of any processing we carried out prior to your withdrawal, nor will it affect processing of your personal information carried out where we are relying on other lawful grounds other than consent.
The right to opt-out of the ‘sale’ or ‘sharing’ of your personal information – Individuals in certain US states can request that organizations do not ‘sell’ or ‘share’ their personal information. Survey.com does not “sell” or “share” your personal information, including your sensitive personal information, with any third parties as these terms are defined in the California Consumer Privacy Act , California Privacy Rights Act or other applicable US privacy laws.
The right to non-discrimination – If you exercise any of the rights listed above, Survey.com will not discriminate against you for doing so. Because you make or have made a data privacy rights request, Survey.com will not: (a) deny you the ability to use our services; (b) charge you a different price or rate for the services, including through the use of discounts or other benefits or imposing penalties; (c) provide you with a different level or quality of service, unless your exercise of rights degrades Survey.com’s ability to deliver the same level or quality of our services; or (d) suggest to you that you will receive a different price or rate for our services or a different level or quality of our services, except where your exercise of rights degrades Survey.com’s ability to deliver the same level or quality of service.
California’s “Shine the Light” law (CA Civil Code Section § 1798.83) permits users of our website who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
8. How long do we keep your personal information for?
We always strive to retain your personal information only for as long as is reasonably necessary to fulfil the purpose for which it was collected. However, if necessary, we may retain your personal information for longer periods of time, until set retention periods and deadlines expire, for instance where we are required to do so in accordance with legal, tax and/or accounting requirements set by a legislature, regulator, or other government authority.
To determine the appropriate amount of time that we retain your personal information for, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information and if we can attain our objectives by other means, as well as our legal, regulatory, tax, accounting, and other applicable obligations.
If you delete your Survey.com account with us, or if your account remains inactive for a period of five years or longer, we will no longer retain your personal information unless we need to in order to comply with a legal obligation, to resolve disputes and defend claims, as well as for any additional purpose based on the choices you have made, such as to receive marketing communications.
Once retention of your personal information is no longer necessary for the purposes outlined above, we will either delete or de-identify it or, if this is not possible (for example, because personal information has been stored in backup archives), then we will securely store your personal information and isolate it from further processing until deletion or deidentification is possible.
9. Children’s Personal Information.
Our Services are not directed at individuals under the age of 18. If you are under the age of 18, please do not use our Services or otherwise provide us with personal information. We do not knowingly collect, sell or share, personal information of individuals under the age of 18. Please see our Terms of Service for further information.
10. International operations and transfers of personal information (for Merchandisers and brand and retail partners based in the EU/EEA and the UK).
As an international entity, in order to provide our services we may need to transfer and process your personal information internationally (including to destinations outside the European Economic Area (the “EEA“) and the UK), notably throughout the Trax Group of companies and to the jurisdictions in which those entities are based, including those listed on our website. This means that when we process your personal information we may process it in any of these countries. We also use service providers and vendors located in and that store your personal information internationally, including in the United States of America.
As a result, your information may be transferred to and/or processed in countries which may not guarantee the same level of protection for personal information as the country in which you reside. In these cases, we have taken appropriate safeguards to ensure that your personal information will remain protected in accordance with this Privacy Policy.
This includes:
a) Implementing the European Commission’s and the UK Standard Contractual Clauses for transfers of your personal information between our group companies, which require all group companies to protect personal information that they process from the EEA or UK in accordance with European Union and/or UK data protection law.

This Privacy Policy applies only to the Services. The Services may contain links to other web sites not operated or controlled by Survey.com (the “Third Party Sites”). The policies and procedures we describe here do not apply to the Third Party Sites. The links from the Services do not imply that Survey.com endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.
12. Security
We understand that you care how your personal information is used and/or shared with others, and we value your trust and seek to safeguard your personal information.
We implement appropriate technical and organizational security measures, including physical, administrative and technical safeguards to protect your personal information from unauthorized access, use and disclosure. To ensure the security of your personal information, we communicate our privacy and security guidelines to all Survey.com employees and enforce privacy safeguards within our company.
